In order to be successful in the ethical realm of retirement planning using insurance and investment options, an advisor must conduct his or her planning sessions in a manner that incorporates the clients as willing and able participants in the planning process. In addition, financial advisors should always conduct their financial planning as a process to potentially help protect and grow clients’ assets or to produce secure retirement income when needed. Oftentimes, this means understanding the true differences between clients’ wants and needs as well as any clients aversion to risk.

With this in mind, advisors must understand that many financial options available may not be the most appropriate solution for a client’s financial needs. If a financial option is not in a client’s best interest, then the advisor should not encourage it. However, educating clients about any financial vehicle he or she are curious about or interested in is the financial advisors responsibility.

In addition to the general ethical principles that an advisor must follow, there is also a need to pay close attention to unfair marketing practices with relation to conduct in promoting financial and insurance-related products and services. These include:

  • Misrepresentation. A financial advisor may not use misleading or incorrect information in the sale of financial or insurance-related products.
  • False advertising. A financial advisor may not use any marketing materials with the intention of stating falsehoods or half-truths.
  • Defamation. It is unethical to damage the character or the reputation of a competitor or his or her products.
  • Twisting or Churning. A financial services representative may not suggest that a customer let an existing insurance policy or annuity lapse so that the advisor may sell him or her another similar product unless it makes good financial sense for the customer to do so.
  • Rebating. Offering a customer an inducement to purchase insurance is considered to be unethical and is even illegal in some states. For example, an insurance sales agent is employing rebating when he or she offers to pay for a client’s vacation or to return a portion of the policy premium from his or her own commission.
